Digital Asset License Agreement

This agreement ("License") governs your use of digital assets ("Assets") provided by SEFKI IBRAHIM 3D LIMITED ("Licensor," "we," "us," or "our") through The Hyperreal Hive membership at www.sefkiibrahim.com ("Website"). By downloading, accessing, or using any Assets, you ("Licensee," "you") agree to be bound by the terms of this License. This License is supplemental to, and forms part of, the Terms and Conditions for The Hyperreal Hive.

  1. Grant of License

1.1. Personal, Non-Commercial Educational Use: Subject to your ongoing compliance with the Terms and Conditions and this License, the Licensor grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Assets for your personal, non-commercial, educational, and portfolio purposes only during your active membership period.

1.2. No Commercial Use Through Membership: This License does NOT grant any commercial use rights for the Assets. Commercial use, including but not limited to use in projects that generate revenue, advertising, merchandise, or any other commercial output, requires a separate, explicit written commercial license agreement from SEFKI IBRAHIM 3D LIMITED.   1. Permitted Uses (Non-Commercial)

2.1. You may use the Assets for: * Learning and skill development. * Personal projects and creative endeavors that do not generate revenue. * Inclusion in personal portfolios, reels, or non-commercial showcases, provided proper attribution is given (as per Clause 5). * Educational purposes within a non-commercial academic or personal learning context.

  1. Prohibited Uses

3.1. You may NOT use the Assets for: * Any commercial purpose without obtaining a separate commercial license from the Licensor. * Resale, redistribution, sublicense, lease, lend, or transfer of the Assets (or any part thereof) to any third party, whether for free or for compensation. * Incorporation into any product or service intended for sale or commercial distribution, including but not limited to video games, films, animations, applications, or physical goods, unless explicitly covered by a separate commercial license. * Use in any stock media platform, including stock photography, video, 3D models, or digital asset libraries. * Training Artificial Intelligence (AI) models, machine learning algorithms, or similar technologies, whether for commercial or non-commercial purposes. This includes, but is not limited to, using the Assets as input data for generative AI models, or incorporating them into datasets used for training or fine-tuning AI systems. * Any illegal, defamatory, obscene, or immoral purpose. * Any use that infringes upon the intellectual property rights of any third party. * Sharing your membership account or direct download links to Assets with non-members.

  1. Ownership and Intellectual Property

4.1. The Licensor retains all ownership, copyright, and intellectual property rights in and to the Assets. You are granted only a limited license to use the Assets, and no ownership is transferred to you.

4.2. You may not claim ownership of the Assets, even if incorporated into a larger work.

  1. Attribution (Recommended)

5.1. While not strictly required for non-commercial personal use, it is highly recommended and appreciated that you provide attribution to "The Hyperreal Hive" or "Sefki Ibrahim 3D Ltd" when showcasing work created using the Assets in your portfolio, social media, or other public non-commercial platforms. This helps support the community and acknowledges the original creator.

  1. Termination of License

6.1. This License is effective from the date you download or access the Assets and remains in effect as long as your membership is active and you comply with its terms.

6.2. Upon termination or cancellation of your Hyperreal Hive membership: * Your right to access new Assets will cease. * You may continue to use Assets that you downloaded during your active membership for personal, non-commercial, educational, and portfolio purposes only. * All commercial use rights (which would have required a separate agreement) are not granted by this License. * Any and all other prohibited uses, including the AI training prohibition, remain in full effect indefinitely.

6.3. The Licensor reserves the right to terminate this License immediately and without notice if you breach any of its terms. In such an event, you must immediately cease all use of the Assets and delete all copies.

  1. Disclaimer and Limitation of Liability

7.1. The Assets are provided "as is" without warranty of any kind, either express or implied. The Licensor does not warrant that the Assets will meet your requirements or that their use will be uninterrupted or error-free.

7.2. To the maximum extent permitted by law, the Licensor shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Assets.

  1. Governing Law

8.1. This License shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
